GORILLASHIP GENERAL TERMS AND CONDITIONS


 

A. This Site

GorillaShip UK / US and its affiliates (individually and collectively, “we”, “our”, “us”, or “GorillaShip”) have developed and maintain www.gshipus.com and www.gorillaship.co.uk (the “Site”) to provide comprehensive information about our company, as well as the range of products and services we offer. The Site also enables customers to register for and purchase these products or services directly. Throughout the Site, the terms “you” and ““your” and "Customer" refer to any individual who views, accesses, utilizes, or acquires information from the Site, including those who obtain information by monitoring activities to and from the Site.

 

B. Acceptance of the Terms and Conditions

These terms and conditions, along with any additional terms, conditions, and documents expressly incorporated by reference, collectively constitute the “Agreement” governing your access to and use of this site, including all content, features, and services available on or through the site. You acknowledge that any contracts, bills of lading, waybills, invoice receipts, customs declarations, and other shipping documentation issued by GorillaShip or third-party service providers are subject to this Agreement. This site contains information, forms, data, text, and other materials pertaining to us, as well as third-party content that is licensed to us.

 

Please review this agreement carefully before accessing or using this website and its services. By entering this site, utilizing its content, or making use of the services provided by GorillaShip, you acknowledge that you have read, understood, and agree to be legally bound by the terms of this agreement. If you do not agree to these terms, you must refrain from accessing or using the site, its contents, or registering for GorillaShip services. Continued use of the site or registration for services constitutes acceptance of these terms and conditions by default.

 

We reserve the right to modify or update this agreement at any time, at our sole discretion, by posting a revised version on the website. The most recent revision of this agreement was made on September 18th, 2024.

 

C. Authorized Use

You are permitted to access and utilize the Site exclusively for your personal use. You acknowledge that the Site and its Content (as defined herein) contain material owned by us or by third parties, which is protected by copyright, trademark, and other intellectual property laws. Any unauthorized use of the Site or its Content may constitute a violation of these intellectual property rights or other applicable laws related to privacy and publicity. Such violations may result in civil and/or criminal penalties.

If you select or are assigned a username, password, or any other piece of information as part of our security protocols or in connection with your use of the Site, you are required to treat this information as confidential and must not disclose it to any third party. You also acknowledge that your account is for your personal use only and agree not to permit others to access the Site or GorillaShip services using your credentials. Please notify us promptly of any unauthorized access to, or use of, your username or password, or any other breach of security. We reserve the right, at our sole discretion, to disable any username, password, or other identifier at any time, with or without cause, including if we determine that you have violated any provision of this Agreement. You are responsible for maintaining the accuracy, timeliness, and completeness of your account information. Should you provide information that is false, inaccurate, outdated, or incomplete, or should GorillaShip suspect as much, we may suspend or terminate your account and deny you access to the Site and its services.

GorillaShip continuously endeavours to prevent fraudulent activity by utilising third-party tools, adhering to industry standards for protecting your account information, and updating our methods and tools as needed. If we are notified of potential fraudulent activity, we reserve the right to withhold processing your shipment until you have verified the transaction or as otherwise determined at our discretion. At times, discrepancies or issues relating to account status or payments may result in a security hold on your account. While under a security hold, charges may still accrue. We will keep you informed of the status and will advise you on steps to resolve any holds on your account.

 

D. Roles and Responsibilities

You acknowledge that GorillaShip does not operate, and does not maintain operating authority to operate, as a transportation provider. GorillaShip receives, stores, and consolidates goods for buyers, such as you, which are sent to a GorillaShip location. On your behalf, GorillaShip utilizes third parties, including sister and affiliate companies, to transport and export your goods. All transportation services are performed by third-party service providers. GorillaShip services and obligations under the Agreement do not begin until your package is delivered and physically received by GorillaShip at the address specified in your account and GorillaShip bears no responsibility for any packages not delivered to a GorillaShip location.

 

E. GorillaShip as Agent

GorillaShip acts as your limited agent for the purpose of performing duties in connection with the preparation and filing of export documentation, including Electronic Export Information (“EEI”), and any other lawful duties which may be agreed upon by the parties in furtherance of the services. You hereby appoint GorillaShip, and GorillaShip accepts such appointment as your limited agent for such purposes. Except for the limited agency granted herein, the relationship between the Parties shall always remain that of independent contractors. By accepting the terms and conditions of this agreement you hereby authorize GorillaShip and any employee, contractor or third party to receive, open and process any mail item delivered to a GorillaShip address.

 

F. Service Providers

All transportation services are performed by third-party service providers. Unless services are performed by service providers engaged pursuant to your express written instructions, GorillaShip shall use reasonable care in its selection of third-party service providers and the means and methods to be followed in the handling, transportation, export, and delivery of your goods. GorillaShip is not responsible for the service provider that is chosen by you. GorillaShip selection of a service provider shall not be construed as a representation or warranty by GorillaShip that such service provider will render services in any particular manner and GorillaShip does not assume any responsibility or liability for any acts, omissions, delay, or misconduct of any service provider. GorillaShip does not ship packages to other package forwarders and does not accept prepaid labels for shipping, except for returns to the original vendor or merchant. You understand and accept that all terms and conditions of the service provider apply to you, and service providers reserve the right to open and inspect shipments. GorillaShip shall not be liable for any delay or loss or any kind which occurs while a shipment is in the custody or control of a service provider or its agents, representatives, or subcontractors and you are responsible for ensuring that the shipping of your package is not restricted by its contents, size, or volume. All claims in connection with the performance or actions of service providers shall be brought solely against such service provider. GorillaShip shall reasonably cooperate with you on any claim against a service provider and you shall be liable for any costs, charges, or fees incurred by GorillaShip arising from such cooperation.

GorillaShip Third-Party Service Providers as of September 2024: FedEx, FedEx Express, FedEx International, Shippo, TGE, UPS, UPS International, DHL, DHL Express & United States Postal Service.

All third-party insurance claims with insurance purchased through GorillaShip will go through a GorillaShip representative. If you have purchased third-party insurance through GorillaShip we will honor all services and work to get your claim handled as quickly as possible. All Third-party insurance claims will be paid out in full to the customer within 90 business days of the claim being filed.

 

G. Legal Compliance

You agree to use the Site or GorillaShip services only for lawful purposes in accordance with this Agreement. You must comply with all local, state, federal, provincial, national, international, and foreign laws, rules, and regulations (including applicable import and export control laws, rules, and regulations of the United States and other countries) in accessing and using the Site or GorillaShip services, and will immediately notify us if you learn of or suspect a security breach or any illegal activity in connection with the Site or your use of GorillaShip services.

 

H. Liability for Loss or Damage

Gorilla Ship’s liability for loss or damage of any goods while in the custody and control of GorillaShip, unless otherwise agreed upon by GorillaShip in writing shall not exceed $100 USD or the cost of your goods, whichever is less. If your goods have a value of $100 or more, you may request upgraded contents insurance which is provided by a third-party insurance company appointed by GorillaShip.

 

I. Termination of Accounts

GorillaShip reserves the right to close any account at any time and for any reason. If your account is closed, you will be prompted to ship the contents of your storage at GorillaShip within 7 business days of being notified of the closure.

 

J. Subscription & Outgoing Shipment Payments

Payments for online subscriptions will be processed on the same day each month until the account is closed and the subscription is cancelled. If a subscription payment is unsuccessful, the account will enter a seven-business-day grace period during which GorillaShip will attempt to process the payment daily. Should payment remain unpaid after the grace period, the account will be closed. Customers who initiate a new subscription within a reasonable timeframe will retain their existing information, including shipping address and name. However, if the account remains unpaid for 30 business days, customers acknowledge and agree that any items left in storage will become the property of GorillaShip and cannot be recovered thereafter.

GorillaShip does not have access to any customer payment information and cannot manually process any payments of any kind without prior consent of the customer. Customers of GorillaShip will be required to process, manage & update any payment information.

 

Shipment request invoices are issued to customers via email once GorillaShip has received a completed shipment request form. The invoice will be delivered to the email address provided on the shipment request form. No shipments will depart from GorillaShip until the shipment request invoice is paid in full, unless an alternative arrangement is agreed upon by both GorillaShip and the customer. Upon receipt of payment, the shipment will be transferred to the third-party shipping provider selected by the customer.

 

K. Prohibited Items

By accepting the terms and conditions of this agreement, you agree not to make any online purchases to any GorillaShip address involving items that are deemed inappropriate, illegal, or prohibited from cross-border shipment or entry into your destination country. A comprehensive list of prohibited items is available online. In addition to these items, GorillaShip does not accept magazine subscriptions, money orders, checks, or verification codes for address verification purposes. Any prohibited item received by GorillaShip will be disposed of accordingly, and appropriate measures will be taken as necessary.

 

L. Reproduction and Counterfeit Goods.

GorillaShip does not accept any reproduction items at any of its addresses, unless these items are reproduced by the original manufacturer. Counterfeit goods, including clothing, collectibles, trading cards, and accessories, will be declined, returned to the sender, and may result in account closure. By accepting the terms and conditions of this agreement, you acknowledge that you will not send any counterfeit or reproduction items to GorillaShip.

M. Refund Policy 

GorillaShip does not offer refunds of any kind unless in good faith and agreed upon by GorillaShip or GorillaShip management and the customer. It is the sole responsibility of the customer to manage the account, utilize the account and manage subscriptions. Gorillaship cannot p
